Welcome to MOM’S CHOICES. This store is operated by SUDHA MANOJ SHAH, a sole proprietor based in Surat, Gujarat, India. Throughout these Terms, “MOM’S CHOICES,” “we,” “us,” and “our” refer to this business.

We operate this website, including its information, content, features, tools, products, and services (collectively, the “Services”). Our online store is powered by Shopify.

These Terms of Service, together with the policies referenced below, explain the conditions that apply when you access our website or purchase from us. By using the Services or placing an order, you agree to these Terms. If you do not agree, you should not use the Services.

SECTION 1 - ACCESS AND ACCOUNT

To place an order, you must be at least the age of majority in your place of residence and legally capable of entering into a binding agreement.

You agree to provide accurate, current, and complete information, including your name, email address, billing information, and shipping address. You must be authorized to use the payment method provided.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Notify us promptly if you suspect unauthorized access.

You may not transfer, sell, or assign your account to another person without our permission.

SECTION 2 - OUR PRODUCTS AND SUPPLEMENT INFORMATION

We sell dietary supplements under the MOM’S CHOICES brand, working with third-party suppliers and fulfillment partners.

We make reasonable efforts to describe and display our products accurately. Product colors and packaging appearance may vary slightly depending on your screen and packaging updates. These variations do not remove your rights if a product is defective, incorrect, or materially different from its description.

Product descriptions, prices, and availability may change. Changes do not retrospectively alter an accepted order unless we notify you and obtain any agreement required by applicable law.

Our dietary supplements are not intended to diagnose, treat, cure, or prevent any disease. Website information is provided for general educational purposes and is not a substitute for professional medical advice, diagnosis, or treatment.

Read each product’s ingredients, directions, warnings, serving instructions, and age restrictions before use. Consult a qualified healthcare professional before taking supplements, particularly if you are pregnant, breastfeeding, taking medication, or have a medical condition.

Our family-focused branding does not mean that every product is suitable for children or every family member. Follow the specific product label and professional advice. Individual results may vary, and we do not guarantee particular health outcomes.

We may discontinue products or limit purchase quantities, subject to our obligations for orders already accepted.

SECTION 3 - ORDERS AND CANCELLATIONS

Placing an order constitutes an offer to purchase. An automated order acknowledgment confirms receipt of your order but does not, by itself, guarantee acceptance or product availability.

We may decline or cancel an order for reasons such as unavailable stock, a material pricing error, inability to verify payment, suspected fraud, or a legal restriction. If we cancel an order after payment has been collected, we will refund the amount paid for the canceled items and any associated charges that are refundable.

Please review your order and delivery address carefully before submitting payment. Orders may enter processing shortly after payment. Contact us immediately if you need to request a cancellation or correction. Changes or cancellations cannot be guaranteed once processing begins, except where applicable law requires otherwise.

Purchases through this store are intended for personal or household use. Commercial resale or export requires our prior written agreement.

SECTION 4 - PRICES AND BILLING

Unless otherwise stated, prices are displayed in United States dollars (USD).

Applicable shipping charges, discounts, and taxes are displayed at checkout before payment. The total shown at checkout is the amount you authorize us or our payment provider to charge.

Your bank or payment provider may apply currency-conversion or other fees under its own terms. Those fees are not set by MOM’S CHOICES.

Prices and promotions may change for future purchases. Promotional offers may have separate conditions, including eligibility requirements and expiration dates.

You agree to provide accurate billing and payment information and represent that you are authorized to use your chosen payment method.

Payments are processed through the payment providers available at checkout and are subject to their applicable terms.

SECTION 5 - SHIPPING AND DELIVERY

We currently ship to eligible addresses within the United States. Orders are fulfilled and shipped from the USA through our fulfillment partner.

Processing and delivery times are estimates unless expressly stated otherwise. Product availability, order verification, holidays, and carrier delays may affect these estimates.

If we cannot ship within the stated timeframe, we will notify you and provide any delay-consent, cancellation, and refund options required by applicable law. If you decline a proposed shipping delay, or we cannot obtain the required consent, we will refund the unshipped merchandise as required.

Please provide a complete and accurate delivery address. Additional shipping costs may apply if a package must be resent because of an incorrect or incomplete address supplied by you.

Nothing in this section removes rights or remedies that cannot lawfully be excluded.

SECTION 6 - INTELLECTUAL PROPERTY

The Services, including our branding, logos, text, graphics, images, videos, and website design, are owned by MOM’S CHOICES or used with permission from the relevant owners.

You may use the Services for personal, non-commercial shopping and informational purposes. You may not reproduce, distribute, sell, republish, or commercially exploit protected content without permission, except as permitted by applicable law.

MOM’S CHOICES names and logos may not be used in a way that implies our endorsement or creates confusion about the source of products or services.

Shopify and other third-party names, logos, and trademarks belong to their respective owners. No ownership or license is transferred to you except as expressly stated.

We may provide access to tools or services operated by third parties. We do not control every aspect of those tools, and their use may be governed by separate terms.

Questions about purchases made directly from a third party should be directed to that third party. Questions about orders placed with MOM’S CHOICES should be directed to us.

MOM’S CHOICES is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with MOM’S CHOICES. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MOM’S CHOICES, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MOM’S CHOICES.

If we cancel a paid order because of an error, we will issue the applicable refund.

Termination does not affect rights and obligations that arose beforehand, including valid payment obligations, refund rights, or claims concerning an existing order.

Provisions that by their nature should continue, including intellectual property, applicable limitations of liability, privacy obligations, and dispute provisions, will survive termination.

We make reasonable efforts to maintain accurate information and a functioning website but do not guarantee uninterrupted or error-free access.

Except for express commitments we make and warranties required by applicable law, the Services are provided “as is” and “as available.”

To the extent permitted by applicable law, MOM’S CHOICES and its service providers will not be liable for indirect or consequential losses arising from use of the Services, such as loss of business profits or business opportunities.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence where such liability cannot be limited, defective products where liability is mandatory, or any other liability that applicable law does not permit us to exclude or limit.

Nothing in this section removes your right to an applicable refund, replacement, or other mandatory consumer remedy.

SECTION 18 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to compensate MOM’S CHOICES and relevant service providers for reasonable losses arising from third-party claims caused by your unlawful use of the Services, infringement of another person’s rights, or material breach of these Terms.

This obligation does not apply to losses caused by our own negligence, misconduct, or breach of legal obligations.

We will provide reasonable notice of a claim and an opportunity to cooperate in its defense. We will not agree to a settlement imposing non-monetary obligations on you without your consent.

SECTION 19 - SEVERABILITY

If a provision of these Terms is found unlawful or unenforceable, it will apply only to the extent permitted by law or be treated as removed if necessary.

The remaining provisions will continue to apply, provided doing so does not defeat the essential purpose of the agreement.

SECTION 20 - WAIVER AND ENTIRE AGREEMENT

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

These Terms, the policies expressly referenced in them, and any terms specifically agreed for your order form the agreement between you and MOM’S CHOICES regarding the Services.

Nothing in this section excludes liability for misleading statements or removes rights that applicable law protects.

SECTION 21 - ASSIGNMENT

You may not transfer your contractual rights or obligations to another person without our written agreement, except where permitted by law.

We may transfer our rights or obligations in connection with a legitimate business reorganization or transfer, provided that doing so does not reduce your existing consumer rights. We will provide notice where required.

These Terms are governed by the laws of India, subject to any mandatory consumer protections applicable in your place of residence.

Courts of competent jurisdiction in Surat, Gujarat, India will have jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.

Nothing in these Terms limits rights or remedies that cannot lawfully be excluded.

Headings are included for convenience and do not alter the meaning of these Terms.

SECTION 24 - CHANGES TO THESE TERMS

We may update these Terms to reflect changes in our business, services, or legal requirements. Updated Terms will be posted on this page with a revised date.

Material changes will be communicated where required by law. Changes will generally apply prospectively and will not retrospectively reduce rights relating to an order already placed.

Your continued use of the Services after updated Terms take effect constitutes acceptance to the extent permitted by applicable law.
